Terms and Conditions

1) All online bidders must submit an application for bidding approval and receive a permanent bidder number from SWICO Auctions before actual bidding can begin. BEFORE submitting registration, you will HAVE to set swicoauctions.com as an approved email sender in your email system in order to receive this and other emails from us. SWICO Auctions will return by email the bidder number within 24 hours of receipt of the application. This bidder number and your driver's license number will allow you to bid on any item and access to your User Page where current bids are shown, past invoices, links for item alerts, updating your data file and becoming a seller on SWICO Auctions web site. Bidders wishing to use resale certificates or farm use or exempt status MUST email proper form, link can be found on the registration or file update page, to jim@swicoauctions.com BEFORE taxes will not be charged to you.

2) All items are sold as is where is, with no warranty or guarantee implied or intended by the seller or the auctioneer. Loading assistance is NOT usually available unless otherwise stated. Any and all loading equipment is to be furnished by the buyer unless prior arrangements are made with the seller. Buyers will be loading their own purchases with no liability as to accidents, load security, or equipment availability towards SWICO Auctions or the seller. All sales are final and the bidder is responsible for knowing which item he is bidding on and we recommend each bidder make every effort to confirm item descriptions to their satisfaction by visual inspection or at least by making contact with the seller for confirmation before bidding on any item. Once the item is declared sold, by voice or online auction closing for bids, it becomes the responsibility of the buyer with all liabilities attached thereto. Should the item turn up missing or damaged at pickup time, please contact the local police authorities and report them as stolen or vandalized, no refunds will be made by the Auctioneer or the seller.

3) All bids will require a maximum bid amount and our program will automatically increase your bid when ever another bid is placed on the item above your current high up to you maximum amount. You may increase your maximum bid at any time and the amount of your current bid will not be increased! Each bid will be increased by an established increment set by SWICO Auctions on each item. All bidding for the online auction items ends at 1 PM CST on the closing day listed for the item. Users acknowledge that SWICO Auctions online auction service may or may not function as designed for reasons beyond our control. Under no circumstances will bidder or seller have any claim against SWICO Auctions, its website designer, host or anyone else if any Internet service is interrupted for any reason causing any problems with the ability to bid or place items for sale. SWICO Auctions will not be responsible for any missed bids!

a)The final internet bid for onsite auctions, which end at 1 PM CST the day before the onsite auction, will be taken to the sale site and used as the opening bid. If your maximum bid is higher than the current bid at closing, then we will bid on site up to your maximum bid. If no one bids against your opening onsite bid, then you will buy the item at that price!

b)In case of an onsite tie bid, the auctioneer has the right to reopen the bidding between the two parties involved to determine the final price. The auctioneer has the final determination in all cases.

c)Items with quantities greater than one will be sold by each, with the bidder choosing the number he wants times the high bid amount. As bids are received each bidder will show up as currently successful for the quantity wanted as long as his bid is equal to or greater than the current bid until all are spoken for, then all bidders will increase by the bid increment as bidding continues with the lowest bid being eliminated when a bid is place higher than theirs. If the quantity bid on is less than the total available, then a bid placed equal to the current bid could get you the available units. Changing maximum or quantity could cause bidding against yourself depending on other bidders maximum bids. Buyer choice is determined by first come first choice! All choice items are listed due to them being as close to identical as possible.

4) Acceptable payment is by Visa, MasterCard, American Express and Discover credit cards. Personal and company checks will be accepted ONLY with an attached bank letter of guarantee of payment or SWICO Auctions prior approval and only for purchases made onsite and presented onsite within thirty minutes of completion of the sale. Online auctions will be invoiced within 4 hours of the closing time with payment being applied to the credit card on file unless prior arrangements are made for wire transfer of funds, no checks accepted for online auction purchases!. All winning bids at onsite auctions will be notified by email with an invoice showing lots purchased, taxes collected, total amount charged to the credit card on file within 24 hours of the completion of the sale. A 5% BUYERS PREMIUM will be added to each purchase, unless otherwise noted. All purchases are due and payable in US funds at Caldwell, Burleson County, Texas, USA.
Included in all emailed invoices will be a contact for scheduling pickup within the 5 business days alloted. Buyers MUST present an invoice as proof of purchase when picking up their purchases from the seller! A copy of all online auction invoices is available from the bidder's user page after processing and will remain there.

5) All items must be removed by noon on the fifth business day after the sale, unless other arrangements are made with the seller during this time frame. Items not picked up will be considered abandoned and properly disposed of by the seller with no refunds!

6) Vehicle title papers will be issued by the seller within 10 working days of the sale to the buyer as registered, unless otherwise notified within 24 hours of notice of award. Odometer readings are not guaranteed to be actual unless so indicated. Gun buyers must be 21 years of age, resident of Texas and we must have your social security number, FFL dealer number or concealed carry number on file before transfer of the firearm.

7) The items described in this listing are assumed to be true and correct to the best ability of the owner and the auctioneer. Any oral statements made during this auction will take precedence over all written notices or advertisements issued prior to the sale.

8) Anyone who fails to complete any transaction associated with any bids placed with SWICO Auctions, will be removed from the bidder list on any SWICO Auctions online bidding and barred from attending any SWICO Auctions on site auctions! Bidders failing to complete transactions in excess of $1000.00 will be sued for breach of contract! Any legal action arising from transactions related to any auction conducted by SWICO Auctions, either being conducted on line or on site, will be conducted in Burleson County, Texas, USA and under the current laws of the State of Texas, USA. All operations of this web page are based in Texas and operated under the current laws of Texas, regardless of user or operator computer location.

9) These Terms and Conditions are subject to change at anytime and SWICO Auctions recommends that they be reviewed periodically to keep up to date on any changes. When placing any bid we remind you co review these terms and provide a link for that review.


10) SWICO Auctions auctioneers are licensed by the Texas Department of License and Regulation, PO Box 12157, Austin, Texas 78711, 512-463-5522. Any complaints or compliments can be turned into the Department for resolution if not properly resolved by SWICO Auctions' personnel.
